A standard Will passes your assets directly to your beneficiaries immediately upon probate. A Discretionary Trust allows you to leave assets to specific, trusted people (trustees) who manage, invest, and distribute the wealth gradually over time. This is standard practice for protecting young children or vulnerable relatives.

If there is no valid Will, the estate must be distributed strictly in accordance with the Succession Act 1965, as amended. For instance, if you leave behind a surviving spouse and children, your spouse automatically receives two‑thirds of your estate and the children split the remaining one‑third, regardless of what your verbal intentions were.
A Section 117 application allows a child to legally challenge a parent's will if they can prove the parent failed in their moral duty to make proper provision for them during their lifetime, whether through gifts, education, or testamentary bequests.
