What is the difference between a basic Will and a Discretionary Trust?

What happens if someone dies intestate (without a Will)?

If there is no valid Will, the estate must be distributed strictly in accordance with the Succession Act 1965, as amended. For instance, if you leave behind a surviving spouse and children, your spouse automatically receives two‑thirds of your estate and the children split the remaining one‑third, regardless of what your verbal intentions were.

What is a Section 117 application?

A Section 117 application allows a child to legally challenge a parent's will if they can prove the parent failed in their moral duty to make proper provision for them during their lifetime, whether through gifts, education, or testamentary bequests.
